Captive agents work for one insurance company.
Independent agents work for many insurance companies.

Look at three things:
Each state has a Department of Insurance responsible for regulating insurance companies doing business within its borders. The duties of each state Insurance department include:
Calculate your loss carefully and negotiate with the company fairly. Do not exaggerate your claim or understate it. If you do the latter you may be giving up future rights to obtain additional damages.
Review the policy carefully and read the definitions section contained within the policy. If the language remains vague and confusing to you, contact your agent with questions. Document his or her explanations in writing, and save your notes from the conversation in your permanent insurance file or notebook.
In most states a disagreement or dispute as to the meaning of ambiguous policy language must be resolved in the policyholder’s favor.
